Criteria for Hiring Foreign Nationals to Work with BOI-promoted Companies

 

For companies that need to hire foreign nationals under the conditions of the BOI, the qualifications must be considered according to the criteria of the Board of Investment (BOI) for hiring foreign nationals to work with companies in Thailand.

The main requirements are as follows:

  1. Activities promoted by the BOI:
    To be eligible to hire foreign nationals, the company must be a BOI-promoted activity.
  2. Positions and qualifications of foreign nationals:
    • The positions that hire foreign nationals must be crucial and necessitate unique skills that Thai workers cannot provide.
    • The foreign nationals hired must have qualifications and experience that match the required positions.
  3. Number of foreign nationals hired:
    The BOI will consider the number of foreign nationals that a company can hire based on the size of the activity and the necessity of using foreign nationals in various positions.
  4. Work Permit:
    Every foreign national hired must obtain a work permit from the Ministry of Labour. The BOI will assist in facilitating this process. Foreign nationals must obtain a Non-B visa (Business) or Non-IB visa (investment promotion) under the investment promotion law.
  5. Reporting and inspection:
    Companies must periodically report the employment of foreign nationals to the BOI, and the BOI may inspect compliance with various requirements.
  6. Other benefits:
    Companies promoted by the Board of Investment (BOI) are eligible for a range of benefits, including exemptions from import duties on machinery and equipment, as well as streamlined processes for obtaining visas and work permits for foreign staff.

Foreign nationals wishing to work with BOI companies must meet one of the following age, education, and experience requirements:

  • At least 2 years of work experience if their educational qualification matches the general position, and they are at least 22 years old as of the application date.
  • At least 5 years of work experience if their educational qualification does not match the position or if they are in a managerial position, and they are at least 27 years old as of the application date.
